Pursuant to and for the purposes of art. 13 of Regulation (EU) no. 2016/679 of the European Parliament and of the Council of 27 April 2016 (“GDPR”) on the protection of natural persons with regard to the processing of personal data, as well as on the free circulation of such data, Dieci Nail World Srl, as “Data Controller” (“Sonya Nails” or the “Data Controller”) informs you that the personal data you voluntarily make available to this site will be processed in compliance with the current legislation on the protection of personal data, meaning, in particular, the GDPR and Legislative Decree no. 196/2003, as amended by Legislative Decree no. 101/2018 (“Privacy Code”) and, in any case, in compliance with the principles of transparency and confidentiality that inspire the Data Controller's activity.

In compliance with current legislation, the processing carried out by Dieci Nail World Srl will be based on the principles of lawfulness, correctness, transparency, limitation of purposes and conservation, data minimization, accuracy, integrity and confidentiality.

The information may be subject to changes due to the introduction of new regulations in this regard, therefore the user is invited to periodically check this page.

1. Object of the processing and categories of personal data processed.

Processing of personal data means any operation or set of operations, performed with or without the aid of automated processes and applied to personal data or sets of personal data, such as collection, recording, organization, structuring, storage, adaptation or modification, extraction, consultation, use, communication by transmission, dissemination or any other form of making available, comparison or interconnection, limitation, erasure or destruction.

The personal data subject to processing, which may vary depending on the services requested and provided by you, consist of:

• personal data: name and surname of the buyer;

• contact details: email address and telephone number;

• bank and/or payment details;

• tax code/VAT number, location data, an online identifier, purchases made, and other data suitable for making the user identified or identifiable;

• data relating to the device used for the purchase such as, for example, type of device, IP address (hereinafter “Personal Data“).

In particular, the Personal Data processed through the Site are the following:

a) Browsing data

When the user visits the websites of the Owner, the servers automatically record information such as the URL, IP addresses, browser type, browser language, date and time of the request made. The transmission of this information is implicit in the use of web communication protocols.

This information is not collected to be associated with identified interested parties, but by its very nature could, through processing and association with data held by third parties, allow users to be identified.

This data is used for the sole purpose of obtaining anonymous statistical information on the use of the site and to check its correct functioning. The data could be used to ascertain responsibility in the event of computer crimes against the site or third parties. With the exception of this eventuality, such data is retained for 30 days.

b) Data provided voluntarily by the user

On the Owner's websites, the user has the possibility to transmit his/her personal data by filling out forms or sending emails. The provision of this data is optional, explicit and voluntary, and involves the subsequent acquisition of the sender's email address, necessary to respond to requests, as well as any other personal data entered for the purposes of the service and those further granted by the user. The user assumes responsibility for the personal data of third parties that may be published or shared through this site and guarantees that he/she has the right to communicate or disseminate them, freeing the Data Controller from any liability towards third parties.

c) Data with interaction with social networks

In addition to filling out the appropriate registration form, the user may be allowed to register for the Services, if he/she has a Facebook profile, also by simply clicking on the “Login with Facebook” button. In this case, Facebook will automatically send to the website some personal data, specified in the appropriate “pop-up” window that is displayed at the time of the request, and there will be no need for the user to fill out other forms.

2. Purpose and legal basis of the processing

The personal data made available to Dieci Nail World Srl may be used for the following purposes:

a) the fulfillment of legal obligations to which the Data Controller is subject, including administrative and/or accounting obligations;

b) the establishment and performance of the contractual relationship relating to the purchase of products through this site and, more specifically: register on the websites of the Data Controller; use the services/products offered by the Data Controller; for control, research and analysis purposes to manage and improve the technologies and services of the Data Controller; receive responses to requests addressed to the Data Controller; fulfill pre-contractual, contractual and fiscal obligations deriving from existing relationships with the Data Controller.

c) Subject to the specific consent of the interested party, personal data are collected to: send newsletters, commercial communications and/or advertising material regarding products and/or services offered by the Data Controller.

The processing of data for the purpose under a) is necessary to fulfill the legal obligations to which the Data Controller is subject, pursuant to art. 6, paragraph 1, letter c) of the GDPR. The processing of data for the purpose under b) is necessary to fulfill the contractual obligations relating to the purchase of products requested by you, pursuant to art. 6, paragraph 1, letter b) of the GDPR. The processing of data for the purpose under c) requires your consent, pursuant to art. 6, paragraph 1, letter a) of the GDPR

3. Methods of processing

The processing of personal data will be carried out using suitable paper, electronic and/or telematic tools, with logic strictly related to the purposes indicated above and, in any case, in such a way as to guarantee the security and confidentiality of the data themselves.

4. Provision of data and consequences of any refusal

The provision of personal data for the purposes under a), b) and c) of the previous art. 2 is mandatory and your refusal and/or the provision of inaccurate and/or incomplete information could have the following possible consequences:

1. the impossibility for the Data Controller to comply with all the provisions imposed by the legislation in force that are instrumental and/or in any case related to the execution of the contractual relationship to which it is subject;

2. the impossibility of stipulating the contract relating to the purchase of products through this site and/or of guaranteeing the regular and timely execution of the relative contractual relationship.

5. Recipients or categories of recipients of personal data

Your personal data may be disclosed to the Data Controller's partners, external data processors, data processors and/or data processors designated by the Data Controller in the exercise of their functions.

Your personal data may be communicated to subjects who provide the Data Controller with performances or services instrumental to the purposes indicated in the previous article 2 such as, by way of example, subjects who manage and/or participate in the management and/or maintenance of the websites and electronic and/or telematic tools used by the Data Controller.

Your personal data may also be communicated (I) to suppliers and/or consultants who assist the Data Controller in various capacities with particular reference to legal, tax, social security and accounting aspects; (II) subjects with whom it is necessary to interact for the provision of the Services (for example Hosting Providers), subjects delegated to carry out technical maintenance activities on the servers that host the Data Controller's websites; (III) persons authorised by Dieci Nail World Srl to process personal data necessary to carry out activities strictly related to the provision of the Services, who have undertaken to maintain confidentiality or have an adequate legal obligation of confidentiality, such as the Data Controller's employees/collaborators; (IV) to the Police Force or the Judicial Authority in the context of investigations or inquiries by the judicial police for the purposes of preventing, ascertaining or repressing crimes; (V) to any other subject to whom the data must be communicated based on an express provision of law.

In any case, your personal data will not be disclosed in any way.

7. Duration of treatment and storage period

Your personal data will be retained only for the time necessary to achieve the purposes for which they are processed or until the consent previously expressed is revoked.

The data processed for purposes related to the fulfillment of legal obligations and contractual obligations referred to in letters a) and b) of the previous art. 2 of this information notice, will be retained for a period of 10 years following the purchase, unless the need for further retention arises, to allow the Owner to defend his rights.

Dieci Nail World Srl adopts adequate security measures to protect data from any unauthorized access, modification or disclosure or from its destruction. Such measures include internal controls on the methods of collection, storage and processing of data as well as on security measures to protect the systems on which personal data are stored from any unauthorized access.

8. Rights of the interested party

We inform you that at any time, in relation to your data, you may exercise the rights provided for within the limits and under the conditions set out in articles 7 and 15-22 of the GDPR.

In detail, you, as the interested party, have the right to:

- obtain confirmation as to whether or not personal data concerning you is being processed;

- if processing is ongoing, obtain access to personal data and information relating to the processing as well as request a copy of the personal data;

- obtain the rectification of inaccurate personal data and the integration of incomplete personal data;

- obtain, if one of the conditions set out in art. 17 of the GDPR exists, the deletion of personal data concerning you;

- obtain, in the cases provided for by art. 18 of the GDPR, the limitation of processing;

- receive the personal data concerning you in a structured, commonly used and machine-readable format and request their transmission to another owner, if technically feasible.

8.1. Right to object

Each interested party has the right to object at any time to the processing of his/her data carried out for the pursuit of a legitimate interest of the Data Controller. In the event of objection, your data will no longer be processed, unless there are legitimate reasons to proceed with the processing that prevail over the interests, rights and freedoms of the interested party or for the establishment, exercise or defense of a right in court.

8.2. Right to lodge a complaint with the Data Protection Authority

Finally, pursuant to Article 77 of the GDPR, we remind you that you have the right to lodge a complaint with the Privacy Guarantor, in the event that you believe that your rights under the GDPR have been violated, according to the methods indicated on the website of the Privacy Guarantor accessible at www.garanteprivacy.it.

10. Changes

The Data Controller reserves the right to modify or simply update the content, in part or completely, of this Privacy Policy, also due to changes in the applicable legislation, by giving notice to users on this page. Therefore, please consult this page frequently, taking as reference the date of the last modification indicated therein. In the event of non-acceptance of the changes made to this privacy policy, the user, if registered on the website, can delete his/her account or can request the Data Controller to remove his/her personal data.
