Dieci Nail World srl manages the website www.diecinail.com

Dieci Nail World srl is registered in the Naples business register with VAT number 09822301215 and with headquarters in Naples in via Maria Longo n.6 (CAP 80138), (hereinafter “Dieci Nail World srl”) invites users to read these General Conditions of Sale (“GCS”) which regulate the purchase of products and the management of orders placed on the site.

“Dieci Nail World Products” are offered for sale on the website www.diecinail.com.

"Dieci Nail World Product/s" means all products offered on the website www.diecinail.com

The General Conditions are valid for all present and future relationships with our customers.

If one or more points of these General Conditions are declared no longer valid, the others retain their validity.

The contract is deemed to be concluded at the seller's premises, even if the negotiations have been conducted by employees or sales agents, who do not have powers of representation of the seller.

1. Conclusion of the contract and delivery of the products

1.1 Each order placed on www.diecinail.com implies the conclusion of a sales contract.

1.2 By clicking on the “Buy Now” button, the customer places a binding order for the items in the virtual cart. Once the order has been sent, Dieci Nail World srl will send the customer an order confirmation email and a confirmation email when the shipment is dispatched. The sales contract is considered concluded between Dieci Nail World srl and the customer when the latter receives the order confirmation. If the customer does not receive any order confirmation within the indicated time frame, the relevant order shall be considered rejected and, therefore, void.

1.3 Orders are accepted based on availability. The buyer undertakes to accept even incomplete or partial deliveries.

1.4 The buyer gives his prior consent to the assignment of the credits for the payment of the purchase price to third parties.

1.5 Where the products in the order are not available for reasons beyond the control of Dieci Nail World srl, the latter shall promptly notify the customer. In such a case, Dieci Nail World srl shall have no obligation to deliver the goods ordered.

In any case, if the products ordered are not available, Dieci Nail World srl will promptly refund the customer any sum already paid.

1.6 Dieci Nail World srl does not assume responsibility for having to search for and obtain unavailable products from other sources. This provision also applies to orders relating to fungible goods (for which only the type and characteristics of the products are described).

Dieci Nail World srl is only obligated to deliver what is available in stock and what has been ordered from its suppliers.

1.7 Delivery will be made by an appointed carrier, the Seller reserves the right to freely choose the carrier based on its own needs for the period. The goods are shipped cash on delivery, up to a maximum of €4,999.00 including VAT (over €4,999 including VAT, payment must be made using the electronic methods available on the site to keep track of them) by national courier, at a cost of €10.00 (max 5 kg); over 5 kg, €2 will be added for each additional kg.

1.8 All shipments travel at the buyer's risk, even in the case of carriage paid deliveries. In no case can compensation and/or withdrawal rights be asserted against Dieci Nail World srl for any damage or delay in delivery of the goods due to transport problems. Any transport damage must be notified immediately in writing on the delivery note to the Carrier and to our company.

2. Prices and shipping costs

2.1 The customer is required to pay the price published on the product page at the time of sending the order. The price indicated is final and includes VAT.

2.2 Shipping costs amount to Euro 10.00 (including VAT) for all orders with a value lower than Euro 100.00, as indicated on the product detail page and in the cart during the order process. These shipping costs are invoiced by Dieci Nail World srl

In the event that the Customer returns the products in accordance with the procedure set out in these conditions and applicable legislation, the shipping costs will be refunded.

2.3 For orders with a value greater than Euro 100.00, shipping costs are free. Shipping costs are always paid by the Customer.

2.4 Our prices are in EURO, including VAT as required by law. The publication of a new price list invalidates the previous one. The minimum amount per order is EURO 5.00.

3. Payment

3.1 Dieci Nail World srl accepts various payment methods including, for example: credit card, bank transfer, Paypal, cash on delivery. Dieci Nail World srl reserves the right to refuse certain payment methods and to request different payment methods for certain orders.

3.2 The buyer agrees to receive invoices and credits exclusively in electronic format.

3.3 The Selling Company reserves the right of ownership of the goods sold until the Price has been paid in full. Only after the price has been paid in full will ownership of the goods be transferred to the Customer; starting from the date of delivery, the Customer acquires material enjoyment of the goods and assumes all risks (in particular, those relating to loss and/or deterioration, theft, fire or other fortuitous event, as well as civil liability towards third parties).

3.4 The Selling Company reserves the right to demand the return of the goods sold with retention of title, if the Customer is late in fulfilling the obligations undertaken with the signing of the Contract.

3.5 The Customer undertakes to carefully and diligently preserve the goods purchased under a retention of title agreement and to provide, at his own expense, for their maintenance and/or any repairs.

3.6 Failure to pay, even of a single instalment of the Price, will result in the termination of the Contract by law. The delivered goods remain the property of Dieci Nail World srl until full payment.

3.7 Liability, defects and returns can be asserted by the Customer within and no later than 7 working days from receipt of the Products.

4. Right of withdrawal for Dieci Nail World Products

4.1 The customer has the right to withdraw from any order regarding Dieci Nail World srl Products with any declaration, provided it is explicit, delivered to Dieci Nail World srl

How to exercise the right of withdrawal

The customer has the right to withdraw from the contract within 14 days. The withdrawal period expires after 14 days from the day on which the customer or a third party, other than the carrier and designated by the customer, acquires physical possession of the last good ordered. In the case of a contract relating to multiple goods ordered by the customer in a single order and delivered separately, the 14-day period starts from the day on which the customer or a third party, other than the carrier designated by the latter, acquires physical possession of the last good.

To exercise the right of withdrawal, it is necessary to inform Dieci Nail World srl (Naples, Via Maria Longo, 6 (CAP 80138) e-mail: info@diecinail.it) of the decision to withdraw from this contract by means of any explicit declaration to that effect (for example, with a letter sent by post, or e-mail).

For this purpose, it is possible to use the standard withdrawal form attached to these GTC (Annex I). If the customer decides not to use the standard withdrawal form attached, he must submit any other explicit declaration of his decision to withdraw from the contract.

In this case, Dieci Nail World srl will promptly send a confirmation of receipt of the withdrawal on a durable medium (e.g. via e-mail).

The deadline set for withdrawal is considered to be respected if the customer sends his/her declaration before the expiry of the 14-day period starting from the day on which the customer acquires physical possession of the last good ordered.

Effects of withdrawal

Following withdrawal from this contract, Dieci Nail World srl will refund all payments made by the buyer, including delivery costs (with the exception of any additional costs resulting from the choice of a type of delivery other than the standard one offered), without undue delay and in any case no later than 14 days from the day on which it is informed by the customer of the decision to exercise the right of withdrawal. Such refunds will be made using the same payment instrument used by the customer during the purchase, unless otherwise agreed between the parties.

In any case, the Customer will not have to bear any costs as a consequence of such reimbursement. The reimbursement may be suspended until receipt, by Dieci Nail World srl, of the products subject to the return.

The customer is required to return or deliver the products without undue delay and in any case within 14 days from the day on which he communicated his intention to withdraw from the sales contract.

The Products must be returned:

- properly packaged in their original packaging, not ruined, damaged or soiled and equipped with all accessories, instructions for use and documentation. In the event of loss of the original packaging, the Customer must, at his own expense, provide for its replacement in order to be able to proceed with the return of the Dieci Nail World Products;

- equipped with the transport document (present in the original packaging), so as to allow Dieci Nail World srl to identify the customer (Order number, name, surname and address);

- without obvious signs of use;

If the returned product does not comply with the provisions of this contract, the withdrawal will not be effective.

The costs of returning the goods are borne by the Customer.

The customer is responsible for any decrease in the value of the goods resulting from handling of the goods other than that necessary to establish the nature, characteristics and functioning of the products themselves.

6. Warranty for defects and non-conformities of the products and additional information

The provisions of the Consumer Code regarding the guarantee for defects and non-conformity of the products apply to purchases made on www.diecinail.com. The customer will therefore be granted the rights set forth in art. 130 of the Consumer Code and such rights must be exercised within the terms set forth in art. 132 of the same Consumer Code.

6.1 Warranty Electrical and electronic products

The warranty on electrical/electronic products is valid throughout the national territory. All are assisted and guaranteed directly by Dieci Nail World srl. The warranty is valid for 12 months from the date of purchase.

In order to obtain repair or replacement under the warranty, the purchaser must take the device to an authorized dealer or send it at his own expense, using a courier or the Italian Post Office at his choice, to our headquarters Dieci Nail World srl – Via Maria Longo, 6 Naples 80138 (NA), using the original packaging and including all accessories (e.g. power supply), together with the relevant receipt or invoice indicating the defect.

Dieci Nail World srl, where the requirements are met in compliance with the evaluation criteria - according to current regulations - will repair the defective parts or replace them or, again, the device as a whole. Repairs not covered by the Warranty and/or resulting from improper use of the purchased product, will be charged to the buyer upon communication for acceptance.

Normal wear and tear (e.g. scratches on the outer casing) and consumable parts (rechargeable batteries, cutter bits, vacuum cleaner bags, filters) are excluded from the warranty. Damage to the appliance caused by use with a voltage other than that indicated on the appliance and damage caused accidentally (liquids, burning embers, electric cable, falls) are also excluded from the warranty.

The purchaser loses the right to the guarantee in the event of tampering, repair or maintenance of the appliance by unauthorised third parties.

The product warranty is recognized exclusively to the original purchaser and is not transferable to third parties.

7. Applicable law

These GTC and the sales contracts are governed by Italian law (and in particular by the Consumer Code - which in articles 46 to 67 regulates distance contracts - and by Legislative Decree no. 70 of 09/04/2003 on electronic commerce) and must be interpreted in light of this. The exclusive competent court for both parties is Naples.
